Terms of Service - Bubble Shooter Puzzle Game

1. ABOUT THESE TOS

Agreeing to these TOS is a precondition for accessing and using our Services. If you accept these TOS, you represent that you are age 13 or older. If you do not agree to these TOS, you may not use or otherwise access our Services.

AIR PATH PTE. LTD. may change and/or update these TOS at any time in response to changing legal, technical or business development reasons. When we do, we will put the changed/updated version online and we will take appropriate measures to inform you via our Services or otherwise. You agree to be bound by the updated TOS by your continued access and/or use of the Services after said updates.

1.1. What are these TOS? These TOS are a legally binding contract between you and AIR PATH PTE. LTD. (incorporated and registered in Singapore, UEN: 202510800C) whose registered office is at FOOK HAI BUILDING 150 SOUTH BRIDGE ROAD #02-008 Singapore 058727 ("AIR PATH", "we", "us", or "our").

1.2. What do these TOS apply to? These TOS apply to our Services, including (but not limited to) the Bubble Shooter Puzzle game, any game features, Virtual Items (defined below), any products and services related to our games, user accounts, customer and technical support.

1.3. When do these TOS apply to you? These TOS will be binding once you access, download, install or use any of our Services. If you do not agree to these TOS, please do not use or access our Services.

1.4. Will we ever change these TOS? We may change and/or update these TOS from time to time, for example to reflect changes in our Services or to reflect applicable laws. If we do, we will make the changed/updated TOS available online and make reasonable efforts to notify you of it. You are welcome to contact us at support@bubbleshooterpuzzle.com if you have specific questions about the changes. If you do not agree to those changes, then unfortunately you must cease using our Services.

2. ACCESSING AND USING OUR SERVICES, YOUR RIGHTS

You have the personal right to access and use our Services. If Services involve a user account, then you are responsible for it.

2.1. License Grant: We give you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable and non-assignable license to use the Services. This license is for your personal non-commercial use only (so you cannot give, 'sell', lend, gift, assign, sublicense or otherwise transfer it to someone else) and does not give you any ownership rights in the Services. You do not receive any other license. We own and continue to own all of our Services including (but not limited to) all copyrights, computer codes, characters, graphics, sound effects, music, and all other intellectual property rights.

2.2. User Accounts: In order to access certain Services features, you may need to create a user account. You are solely responsible for protecting your user account and for your account activities. In particular, keep your account and password secure. We reserve the right to reject any user account if it would breach these TOS or other applicable rules.

2.3. Age Restrictions: You must be at least 13 years old to use our Services. If you are under 18 years old (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these TOS on your behalf. We may collect personal information from users aged 13 and older with appropriate consent in compliance with applicable data protection laws including GDPR.

2.4. Minimum Requirements: Some of our Services may have minimum technical requirements depending on your device/platform. It is your responsibility to ensure you meet these requirements before accessing or using the Services. Internet access is required for certain features.

2.5. Third-Party Services: You might get links from us to third party websites or content through the Services. Your use of them is your responsibility – we cannot promise they will work, what they will be like or if they are free. The Services may contain third party services such as gameplay recording and sharing, social media connectivity, and in-game advertisements. These services are subject to respective third-party terms and conditions.

3. PAYMENTS AND VIRTUAL ITEMS

3.1. Virtual Items: Our Services may offer virtual items such as power-ups, boosters, extra lives, or other digital content (collectively "Virtual Items") that can be purchased with real money. Virtual Items have no monetary value and are licensed, not sold, to you. Virtual Items cannot be transferred, traded, or exchanged for cash or other items of value.

3.2. Payment Processing: All payments are processed through third-party payment processors including PayPal. We do not directly process, store, or have access to your payment card information. By making a purchase, you agree to the payment processor's terms of service and privacy policy. Your payment information is subject to the security measures of our payment processors.

3.3. Pricing: All prices are displayed in the currency specified at the time of purchase and are subject to change without notice. You agree to pay all applicable fees and taxes associated with your purchase.

3.4. No Refunds: All purchases of Virtual Items are final and non-refundable except as required by applicable law. If you believe you have been incorrectly charged, please contact us at support@bubbleshooterpuzzle.com within 14 days of the charge.

3.5. Payment Security: We are committed to ensuring payment security and comply with industry standards. However, all payment card information is handled exclusively by our PCI DSS compliant third-party payment processors. We never store, process, or have access to your complete payment card details.

4. USER CONDUCT AND PROHIBITED ACTIVITIES

In order for you to access and use the Services, we ask you to follow some rules. Please read these rules carefully since failure to follow them will be considered a material breach of these TOS, which may lead to suspension or termination of your access to the Services. You agree to:

• Personal Enjoyment: Only access and use our Services for your personal enjoyment and not for any commercial, advertising, or political purposes.
• Restricted Access: Do not attempt to copy, rent, sell, lend, lease, sublicense, distribute, publish or publicly display the Services, Virtual Items, or any user account.
• Technical Misuse: Do not modify, merge, distribute, translate, reverse engineer, or attempt to obtain or use source code of, decompile or disassemble the Services unless specifically allowed by applicable law.
• No Cheating: Do not create, use, make available and/or distribute cheats, exploits, automation software, robots, bots, mods, hacks, or other software that interacts with or affects the Services in any unauthorized way.
• No Harassment: Do not hack, harm, grief, harass, threaten or misuse the Services, other users, or any staff members.
• Lawful Use: Only use the Services in compliance with all applicable laws and regulations.
• Accurate Information: Provide accurate, current, and complete information when required.

5. INTELLECTUAL PROPERTY

5.1. Our Rights: All rights, title, and interest in and to the Services, including all intellectual property rights, are owned by AIR PATH PTE. LTD. or our licensors. The Services are protected by copyright, trademark, and other laws of Singapore and international treaties.

5.2. Your Content: If you submit, post, or transmit any content to or through the Services (such as gameplay videos or screenshots), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and promoting the Services.

5.3. Trademark: "Bubble Shooter Puzzle" and related logos and names are trademarks of AIR PATH PTE. LTD. You may not use our trademarks without our prior written permission.

6. DATA PROTECTION AND PRIVACY

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. Our Privacy Policy is incorporated into these TOS by reference.

We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) for users in the European Union, and Singapore's Personal Data Protection Act (PDPA).

7. TERMINATION

7.1. Your Rights: You may stop using the Services at any time. If you have an account, you may request account deletion by contacting us at support@bubbleshooterpuzzle.com.

7.2. Our Rights: We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these TOS. Upon termination, your right to use the Services will immediately cease, and you will lose access to any Virtual Items or account features.

7.3. Effect of Termination: Termination does not entitle you to any refund of fees paid for Virtual Items or other Services. Sections of these TOS that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions.

8. DISCLAIMERS AND LIMITATIONS OF LIABILITY

8.1. "AS IS" Basis: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.2. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIR PATH PTE. LTD., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services; or
• Unauthorized access, use, or alteration of your transmissions or content.

8.3. Maximum Liability: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST SIX (6) MONTHS, OR SINGAPORE DOLLARS $100, WHICHEVER IS GREATER.

8.4. Health and Safety: Please be aware our Services may contain flashing images which may potentially trigger seizures for people with photosensitive epilepsy. Player discretion is advised. Take regular breaks while playing.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless AIR PATH PTE. LTD., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, your violation of these TOS, or your violation of any rights of another person or entity.

10. DISPUTE RESOLUTION

10.1. Informal Resolution: If you have any concerns or issues, please contact us at support@bubbleshooterpuzzle.com. We hope we can resolve any complaints quickly and amicably through informal dispute resolution. We both agree to make reasonable and good faith efforts to resolve any dispute informally for a period of 30 days before pursuing formal legal action.

10.2. Governing Law: These TOS and any dispute arising out of or relating to these TOS or the Services shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

10.3. Jurisdiction: You and we agree that any dispute arising out of or relating to these TOS or the Services shall be subject to the exclusive jurisdiction of the courts of Singapore. You consent to the personal jurisdiction of such courts and waive any objection as to inconvenient forum.

10.4. Limitation on Claims: You and we agree that any claim arising out of or related to the Services must be filed within one (1) year after the claim arose; otherwise, such claim is permanently barred.

11. GENERAL PROVISIONS

11.1. Entire Agreement: These TOS, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior agreements and understandings.

11.2. Severability: If any provision of these TOS is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

11.3. No Waiver: Our failure to enforce any right or provision of these TOS will not be considered a waiver of those rights.

11.4. Assignment: We may assign, subcontract, or transfer these TOS to a third party or another member of our group if necessary for business reasons. We will notify you if this happens. You may not assign or transfer these TOS without our prior written consent.

11.5. Force Majeure: We shall not be liable for any failure or delay in performance under these TOS due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

11.6. Export Controls: You agree to comply with all applicable export and import control laws and regulations in your use of the Services.

11.7. Language: These TOS are provided in English. Any translation is provided for convenience only. In the event of any conflict between the English version and any translation, the English version shall prevail.
